A  child born in the Spring of 2019 was not registered, which is required under the Birth and Death Registration Act of 1953 whose purpose is to create a public record relating to all births and deaths in England and Wales.  It requires that every birth of every child born in England and Wales to be registered by the registrar of births and deaths. The law also stipulates who are qualified to give the birth information, which includes both mothers and fathers as well as any person having charge of the child. The father is opposed to registration, the mother is not prepared to register the child but is not opposed to someone else registering on her behalf. 

The social services department has the responsibility for the baby's welfare and it is that organization which asked the high court to intervene once the man and his partner (which are not identified for legal reasons) failed to register the birth.  The father and his partner are being assessed for parenting skills, before the child's long-term future are made. The father's behavior before a family court judge resulted in a prison sentence for him and his partner.

The judge ruled it was in the best interest for the child to be have his birth registered in order for him to be recognized as a citizen and entitled to benefits of citizenship.

History

The father's "unique" belief is that when a child is registered it "becomes an asset to the country" and therefore his son will become controlled by a State which he perceives to be authoritarian and capricious.  The father regarded registering a birth as the equivalent of making an entry on to a ship’s manifest.

Delaware HB 114 was amended from extending embargo periods for birth, marriage and death records to increasing the embargo period for marriage records only- and then only for ten years.  Under the new law, marriage records are now embargoed for 50 years. Additionally,  the law requires an analysis of any further embargo enlargements as well as the granting of limited disclosure.  The bill was signed by the governor on June 26th.  The more palatable bill is due to the work of the genealogical community and Senator Stephanie Hansen who is her family genealogist.  When the bill was passed out of its original house of origin, the House, it had embargo periods for birth records from 72 years to 80 years for date of birth and from 40 years to 50 years for death and marriage.

Senator Hansen is facilitating a meeting of interested parties, including the genealogical community, the county clerks of the peace and the office of vital records to discuss the issue of what information should be able, when, how, and by whom.

*  (US) National Archives Digitizes More than 500 Volumes of US Navy Muster Rolls from 19th Century


The US National Archives has partnered with the Joint Institute for the study of Atmospheric and Ocean (JISAO), the National Oceanic and Atmospheric administration (NOAA) and the University of Washington to digitize more than 500 volumes of US Navy muster rolls from the 19th century. These are now available to the public through the National Archives Catalog.

The muster rolls are the official lists of enlisted sailors from 1861 to 1879.  The muster roll data provide not only the names, birthplaces, ages, discharges, and physical description of enlisted seamen but also information on contraband sailors.

If you are looking for ships’ muster rolls for later years you can help:  The National Archives will digitize thousands of Navy logbooks containing new-to-science ocean and weather data as well as the names of ship’s officers and other details of daily shipboard life. After the digitization of the logbooks is complete, the Archives and NOAA will call upon citizen archivists, genealogical researchers, and climate scientists to help transcribe information from the logbooks and muster rolls into digital formats usable by computers. Citizen archivists can now transcribe this muster roll data from the catalog.


* (Germany) StaatsArchiv Destruction of Death Certificates from 1876-1953 Topic of Archiv Journal


In 2018, it became known that the StaatsArchiv Hamburg did on the unconscionable destruction of over one million death records from 1876-1953.  This was taken very seriously and IAJGS amongst others wrote to various Hamburg officials. IAJGS received a response from Dr. Carsten Brosda, Free and Hanseatic City of Hamburg Minister of Culture and Media.  In the letter he acknowledges that the State Archives reviewed their actions and concluded their decision to appraise the series was "flawed". "Both the Ministry for Culture and Media and the State Archives were going to hold  discussions with historians and researchers on the matter.

The August 1 edition of the Archiv Journal is devoted to this archival records tragedy-where they do call it an error.  This includes the discussion with the archivists and researchers.

* (Australia) National Archives of Australia Racing to Digitize Magnetic Tape Collections


The National Archives of Australia (NAA)  are racing to digitize their magnetic tape collections before 2025 when it will become impossible to find working tape playback machines. This is not a problem unique to the Australian archives. Tapes can only be read by format-specific machines, unlike film.  The heads on the machine readers have a finite number of hours before it needs replacement, During the latter half of the 20thcentury many archives created magnetic tape files, using Betamax versions.  In 2016, Sony announced they would stop making Betamax tapes. The machine readers used by the NAA are obsolete and have not been manufactured for years.

The National Archives of Australia has 13,000 hours of audio and video tape that need to be rescued. Tapes contain Australian government agencies actions which the Archives needs to retain to fulfill its mission of preserving the history of the Australian government which affect the rights and entitlements of Australians.  NAA is trying to find tape machines where ever they can find them.

KARRAKATTA CATASTROPHE...

For some time now, many of you have been aware that 'honouring the dead' seems something that has been pushed aside .. all for what. Like thousands of others, I am utterly disgusted that, in this vast land of ours, headstones are being removed, destroyed or discarded... supposedly as a lack of space makes this imperative.

The fact that families have often scrimped and saved, some for many years, to give their loved ones a final resting place, peaceful and memorialised by a headstone that honours their life, seems to matter not one iota.  There is a lot I could say, but most of it you have heard before... instead, let me share the heartbreak of one friend, who has been personally affected.. 


Carolyn's mother......

It is only after a battle and many many hours of protesting, begging, pleading, that their combined grave is safe...


Not so the following...there are too many family to be able to afford the cost of renewal... remembering that when these gravesites were 
purchased, there was no thought of having to pay again...

(US-IL) Illinois Governor Pritzker Signs DNA Data Protection Law
Illinois Governor Pritzker signed HB 2189 into law. The new law, Genetic Information Privacy Act, provides that long term care insurance or life insurance policies may not seek information derived from direct-to-consumer  genetic testing. The new law also prohibits direct-to-consumer commercial testing from sharing the genetic test information or other personally identifiable information about a consumer from life or health insurers without written consent from the consumer.

The IAJGS Records Access Alert reported last April about Reclaim the Records suing the New York City Department of Health for public copies of all 1949-1968 NYC death certificates under the Freedom of Information Law (FOIL).  The 1949-1968 time frame for these records was requested as any other part of New York State the records would be available. This is the first attempt for records, not indexes.  They are also suing to strike down the NYC Department of Health regulation with the exceeding long embargo dates for birth 125 years  and death records 75 years.

As reported on the Reclaim the Records website (See: first URL above) , New York City has responded-with a motion for dismissal.—they think the statute of limitations has passed. The difference is they are looking at when the regulation was first proposed not when it became effective.

(US-AZ) Arizona Court Rules Arizona Residents Have Right to Internet Privacy
The Arizona Court of Appeals  said Arizonans have n (Arizona) constitutional right to online privacy to prevent police from accessing one’s identity or home address from a third-party online—law enforcement requires a warrant.  The court ruled that the  Arizona constitution provides residents the right to privacy that goes beyond the Fourth amendment protection from unreasonable searches.

Presiding Judge Eppich wrote, "The third-party doctrine allows the government a peek at this information in a way that is the 21st-century equivalent of a trip through a home to see what books and magazines the residents read, who they correspond with or call, and who they transact with and the nature of those transactions… We doubt the framers of our state constitution intended the government to have such power to snoop in our private affairs without obtaining a search warrant."

Police and government agencies cannot obtain information about individuals  to Internet providers, which includes who they are and their home address– the gateway to finding out exactly who is posting material – without a search warrant. And that requires a showing of some criminal activity.

The Arizona ruling is a first time in the state as federal courts have consistently ruled that once people furnish that information to a third party, which in this case the company that provides Internet service, they have given up any expectation of privacy. And that means the Fourth Amendment protections of the U.S. Constitution against unreasonable search and seizure no longer apply and the government no longer needs a warrant. However, the court majority said the Arizona Constitution makes the federal court rulings in applicable.  The court also said the law will need to resolve this tension in such a way that everyone has the same expectation of privacy online.


Despite the court’s ruling they upheld the convictions of the appellant.

Governing To Stop Publishing
In order for me to report on various items affecting access to records which we as genealogists need, I read many different newsletters, blog posts, Google alerts and more. One of the online newsletters I receive by email  is Governing which provides information and stories on US state and locality laws and regulations. Today they announced, like so many other publications, they are “discontinuing operations” this fall after 32 years of publishing. Today’s media environment has changed and more “traditional” types of communication can no longer afford to continue.  This is not the first publication to close and sadly it won’t be the last.

(UK) Changes in Registration of Marriage to Become Effective December 2, 2019
Earlier this year, the Civil Partnerships, Marriages and Deaths (Registration etc.) Act passed into law and received Royal Assent in March 2019. This law made provisions for the extension of civil partnerships to same sex couples, to make a provision for a report on registration of pregnancy losses, still births and  provides for mother’s names to be included on marriage registers. The law also requires the Registrar General to maintain a register of marriages in England and Wales which is accessible in electronic format 

The Faculty Office is the Archbishop of Canterbury who has the power to grant all manner of licenses, etc. and is presided over the Master of the Faculties and its day to day administration is the responsibility of the Registrar. Those functions are now threefold: the issue of Special Marriage Licenses, the regulation of the Notarial profession and the legal work for the awarding by the Archbishop of “Lambeth” Degrees. In that capacity they have posted about the new law and its effective date for the General Registrar Office (GRO) to be ready with the new requirements. Representatives of the Faculty Office and the Legal Offices of the Church of England and Church in Wales have been in discussion with the General Register Office (GRO) about the proposed changes. The GRO has stated the new requirements will be in effect as of December 2 even though the Faculty Office believes there are number of unresolved issues.

The new system replaces Marriage Registers and Marriage Certificates (issued at the time of the wedding) with a Marriage Document prepared by the officiant. What is new, is that the married couple is now responsible for ensuring that the Marriage Document is deposited with the local Register Office within 7 days of the wedding date and the local Superintendent Registrar is then responsible for recording the details and issuing the Marriage Certificate.

FGS and NGS Announce Intent to Merge  At the opening session of the Federation of Genealogical Societies (FGS) conference in Washington D.C  it was announced that the  FGS and National Genealogical Society (NGS) intend to merge.  The two organizations, will form one consolidated group that will continue to operate as the National Genealogical Society. The merger will be completed October 1, 2020. Until then, both organizations will continue discussions and both will hold their 2020 conferences as planned: FGS in Kansas City and NGS in Salt Lake City. The first merged conference will be held in May 2021 in Richmond Virginia. That conference will expand from 4 to 5 days allowing for a society management additional day. Records-access-alerts

(Australia) Family History Month in Australia- Victoria with Reduced Price for Downloadable Historical Certificates
Marking family history month in Australia, the State of Victoria (which includes Melbourne), has reduced the price of their downloadable uncertified historical certificates to $20 (AUS) for the month of August only. Embargo periods for births are 100 years; marriages 60 years and deaths 30 years. Birth records start from 1853, marriages and relationships from 1853 and deaths from 1853.

(US) National Cemetery Veterans Searchable Online tool    
The Department of Veterans Affairs and National Cemetery Administration has announced a new searchable online tool for fallen service members buried in national cemeteries across the United States. This covers 136 national cemeteries with 3.7 million veterans are buried. There is a profile page for each service member.

To find a memorial profile, go to https://www.vlm.cem.va.gov  search the name of your veteran, using their first and last name.

Multiple States Attorney Generals Preparing Joint Antitrust Investigation of Big Technology Companies

Up to 20 US State Attorney Generals are preparing to move forward with a joint antitrust investigation of big technology companies. It is expected to be launched next month.  According to the Wall Street Journal,” it is likely to focus on whether a handful of dominant technology platforms use their marketplace powers to stifle competition.”  Last month the US Justice Department announced its own antitrust review.

(US) National Archives Enters Into Digitization Partnership to Digitize US Navy and Coast Guard Deck Logs from Vietnam

The (US) National Archives announced they entered into an digitization agreement with the US Department of Veterans Affairs for US Navy and Coast Guard deck logs from vessels with Vietnam-era service.

US deck logs is a daily report of ship activity, including information regarding the ship’s heading speed, locations and in some cases  include information on combat operations, accidents, injuries, and other personnel events.  The agreement covers the deck logs from 1956-1978.

There are 20 million images from the U.S. Naval and Coast Guard deck logs.  The project will support processing of veterans’ claims, including those related to the Blue Water Navy Vietnam Veterans Act of 2019, and eventually facilitate increased access to these records by researchers in a digital format without having to travel to a National Archives facility.

Archivist of the United States David S. Ferriero said, “Our goal is to support the processing of claims by the VA and enable sailors to relive their tours online through the actual deck logs, to pinpoint where they served."

For those who served or have family who served during the Vietnam-era on US Navy or Cost Guard ships the information will have genealogical value.

The Eltham Cemetery Trust needs your help.
Are you related in some way to Michael Dillon (1851-1916) or Bridget Cecilia Dillon (1849-1927) who are buried in the Eltham Cemetery?
It is our understanding from a rudimentary search of records available from Ancestry.comthat Bridget was the daughter of John Wright MURRAY(1816-1867) and Mary SWEENEY(1833-1909). She married Hamilton DRAIN(1847-1886) in 1884 and they had a daughter, Mary Ellen DRAIN(1886-1888).
Following husband Hamilton Drain's death in 1886, and her infant daughter Mary's death in 1888,  Bridget married Michael Dillon in 1894. It appears that she and Michael had no children together.
Electoral roll records indicate that Michael was a farmer and that he and Bridget lived in Research, Vic.

(US-Michigan) Michigan Archives New Website

The Archives of Michigan have a new website, https://michiganology.org/. The collection will grow over the next months. Currently, they discuss Michigan death records which are searchable from 1921 to 1947. The collection will grow from 1897 to 1952. Death certificates from 1897 to 1943 will display full images while 1944 to 1953 will only provide index information It appears that birth certificates are not yet added to the new website.

NYC Police Department Photos Over 100 Years to be Made Public
The New York City Police Department has photos over 100 years old documenting the history of NYC. The photos are being digitized and will be made available to the public-it might take 20 years to complete the digitization.. The photos range from the 1800s to today and show buildings as well as people. The photos are being donated to the NYC Municipal Archives—so far 65,000 frames covering four years have been donated. A CBS exclusive report talks about the photos and they went to the basement of police headquarters to interview staff.  The article which includes a video may be read at: https://tinyurl.com/y3m7wef8

(South Africa) National Archives of South Africa has a New Website
The National Archives and Records Service of South Africa (NARSSA) has a new website: https://www.nationalarchives.gov.za/.  Go to collections and the dropdown menu and click on search the collections or, go to: https://www.nationalarchives.gov.za/node/737  for guidance about using the search function. No registration is necessary to search data. The new website lacks a Soundex feature so creativity in spelling in surname variants is suggested. Data is still being migrated to the new website although 7.5 million entries have been migrated. 
 To learn how to search on the new website go to  aforementioned link and there is a link on how to use the database.  Only the new website will be updated although the old website is still active.
