Something completely different this week, back to our travels next week…

Third Contingent Australians, Boer War, Trove Tuesday 4th Sept 2018, lists of names, incl. addresses,  images, independent military forces, unification of forces, British Empire..Canada, New Zealand, Natal, Cape Colony, Breaker Morant, 

I came across these photos of enlisted men a little while back and simply couldn't resist... the story was waiting in the background and begging to be shared.
So, while not some dreamy or interesting place to put on the bucket list, I hope you find it as interesting as I did and maybe even find an image of an ancestor. There is so much more available on TROVE re this conflict, and detailed descriptions of not only Australia's involvement, but of how men came from many countries around the world to be part of this oft forgotten war.

Reclaim the Records has announced that their Freedom of Information request (FOIL) from 2017 to the New York State Department of Health for the birth index in 2017 has been fulfilled. The dates of 1881-1934 are currently online at the Internet Archive and the remaining years 1935-1942 will be online by the end of this week! Note: These are New York State not New York City birth indices. New York City is a separate US Public Heath jurisdiction from New York State. Additionally, the cities of Albany, Buffalo and Yonkers are not included until about 1914 or 1915 as they did not initially participate in statewide registration of births and kept their own records. Later years of the birth index may become publically available after 75 years and each January Reclaim the Records will make new FOIL requests for each newly-available year of data. Note: NY State has a 75 year embargo on  birth records and the person is known to be deceased. To get to them on Internet archive go to: https://archive.org/details/nybirthindex?sort=titleSorter.  There is a magnification option as the writing is small.
The index is sorted by year and then alphabetically by surname within each year. The town is listed and the certificate number is also available. That is how I found my uncles' birth index above.

Previously, the statewide birth indexes were only available to those located in upstate New York Public libraries and the New York City branch of the National Archives. Those were only available on microfiche sheets.  On Internet Archive you can browse the images, download the images and repost to your own website or transcribe to your own database. For now the database is image only-it has not yet been indexed. Reclaim the Records stated they think in the next year or two several of the genealogy websites will be working on indexing projects to make them text-searchable. Reclaim the Records has contacted the State Department of Health about 66 missing microfische sheets for 1905.

Some, not all original birth names for New York State adoptees are listed in the index as the state  reused the same certificate number on both the original and amended birth certificates, tying together the old and new name.

Once you found the name and certificate number you can order a copy of the original certificate which has additional information. You can order the record directly from the New York State Department of Health in Albany NY by going to: https://www.health.ny.gov/vital_records/birth.htm You can also go to the local city or town clerk where the birth took place. Be aware some towns only provide a typed extract of the information not a copy of the actual certificate as it may be in a "binder book" with other events and they cannot share the additional information on the page. Albany may take up to 8 months to fulfill the request.

Ancestry is a subscription site, with many public libraries having access to the database, whereas Reclaim the Records has posted them to Internet Archive (https://archive.org) with free access.

This could affect many of us who research in United Sates, Mexico and Canada...

The recent agreement by the United States, Mexico and Canada, replacing NAFTA, known as USMCA, has a provision extending copyright in Canada for an additional 20 years. Before the agreement copyright in Canada was 50 years after the death of the author now it is 70 years from the death of the author.  Copyright applies to all original literary, dramatic, musical and artistic works. 
Gail Dever's blog, Genealogy à la carte lists the general categories as:

·         literary works such as books, pamphlets, computer programs and other works consisting of text
·         dramatic works such as motion picture films, plays, screenplays and scripts
·         musical works such as compositions with or without words
·         artistic works such as paintings, drawings, maps, photographs, sculptures and plans

The trade agreement still has to go through the approval process which the signatories are hoping will be done before the change in president's in Mexico and possible change of majority party  in the US Congress.

To read the trade agreement see: https://ustr.gov/trade-agreements/free-trade-agreements/united-states-mexico-canada-agreement/united-states-mexico. In total, the USMCA is 1,809 pages —1,572 pages for the treaty itself, 214 pages for annexes, and 23 pages for side letters. 
The copyright provision is  in section 20-H-7 page 20-33 under chapter 20 intellectual property rights.

This is the short version of what I have written... feel free to adapt it. Do include your contact details, name and address is fine. Make sure you include the link as I suspect many politicians might not know about this...

"As I believe that this applies to all Australians, present and future, I am asking you to consider this submission.

I am one of many who are alarmed at the proposed changes to the marriage forms. 


The changes suggested will certainly affect future family historians, but will also affect many families directly. It is a forgone right to know the names of our ancestors, as well as where they lived, what their occupation was, mother’s maiden name and whether any of the parents of the people concerned are deceased at the time of the marriage.

By simplifying this form, what could possibly be the advantages? As I see it, we will be losing valuable information that can help families trace their ancestors. In today’s society, we are more open to helping adopted people find their biological parents… where there is mutual agreement. This will make that harder.

We are often looking to trace ancestors for knowledge of medical history… this will be much harder, if not nigh impossible to do that.

There are times when we are trying to trace those entitled to an inheritance... marriage certificates, along with other certificates, are invaluable.

We, in Australia, are fortunate to have some of the best certificates in the world. Why change it ?

I would appreciate an acknowledgement and explanation.

The Australia Notice of intended Marriage (NOIM) form is being considered to have changes that are important to genealogists.  

Included in the suggested changes that would eliminate certain information are:

Father's name in full  (if not known write unknown) if deceased add deceased.
Mothers maiden name in full  ( if not known, write unknown, if deceased, write deceased.
Usual place of residence
Usual occupation

Feedback is being requested by the Commonwealth Attorney-General's Department. The deadline is 28 October 2018. To see the notice and  submit comments see: https://www.ag.gov.au/Consultations/Pages/review-marriage-forms-noim.aspx.

The decision to make changes is a result of Marriage Equality Act  as of December 2017 and to streamline the forms. Any change on the NOIM will also impact other official marriage forms, specifically the Official Certificate of Marriage, and the Declaration of No Legal Impediment to Marriage.

Staatsarchiv Hamburg
On September 9  The IAJGS Records Access Alert first reported on the unconscionable destruction of over one million death records by the Staatsarchiv Hamburg. At the time there were few European news articles about this travesty. Since then there have been more news articles and several blog posts by other genealogical writers. 

The IAJGS Public Records Access Monitoring Committee has taken this very seriously.  We have submitted letters to the president of Bundesarchiv even though the structure of the German archives is such that the federal archive, the Bundesarchiv, does not have authority over the state archives such as Hamburg's Staatsarchiv. Additionally, IAJGS submitted letters to the Mayor of Hamburg, the president of the Hamburg Parliament (Buergerschaft) and the Minister of Culture and Media for Hamburg. Our letters expressed our concern over the Destruction and hopes that action will be taken to prevent such action in the future, and to support a commission that would include a genealogist along with historians.

Genealogists love cemeteries and traveling to find ancestors final resting places.   On October 3 the United States Supreme Court heard a case Knick v Township of Scott which should be of interest to genealogists. In this case a landowner doesn't want to comply with a local cemetery-access law and permit genealogists, among others,  on her land to visit graves buried there in a private cemetery.

Mrs. Knick owns the property since 1970 where genealogist Robert Vail found his ancestor Micah Vail is buried. He wants to visit the grave site and honor his ancestor. There are other relatives buried there going back to the Revolutionary War.  While Mrs. Knick denies a cemetery is on her 90-acre property she believes she should be paid by the government or visitors to visit the property.   Under an ordinance in Scott Township, Pennsylvania, landowners must provide daytime access to cemeteries on private land or else face a fine. But Knick, not wanting to open her private property to the public, has refused.

Knick sued the township in 2003 and the Court of Common Pleas dismissed her case as have the US District Court and the Third Circuit Court of Appeals.  She contends the ordinance violates her Fifth Amendment right to "just compensation " for public use of her land.

The US Supreme Court will weigh in on a procedural matter, not whether Vail or others may access the cemetery. The procedural question the Supreme Court will weigh is whether a pre-existing court decision should affect how landowners like Knick file complaints about federal taking claims. Under the Supreme Court’s ruling in Williamson County Regional Planning Commission v. Hamilton Bank (1985), landowners suing about federal land seizures have to go through the state courts before filing in federal courts.

Because of the Williamson decision, Knick was not able to file in federal court as she preferred. For Knick to win the Supreme Court would have to overturn Williamson. A decision is not expected until June 2019.

Access issues to cemeteries vary by state and jurisdiction.  Pennsylvania, for example, mandatesthat property owners grant individuals “reasonable ingress and egress to a burial plot.” (So even if a court strikes down the Scott Township ordinance, Knick may still have to comply with this state law.)

The British Red  Cross Museum and Archives has launched a new online database of historic artifacts. Of the museum's 56,000 items, the database includes 28,752 items, including letters, posters, photographs and films. It covers the past 150 years of work of the British Red Cross. Items will be added to the database if they are permitted to do so under the data protection laws.

The database is searchable by keyword, name, type of object and color.

The International Tracing Service (ITS) added 900,000 post-war documents online. This brings the total of number of documents freely available in the online archive to over 2 million. One can search by name. The newly added documents contain approximately 405,000 names of Holocaust survivors, former concentration camp inmates and forced laborers. They were under the care of the International Refugee Organization (IRO) in Austria, Italy, Switzerland and England after World War II. 

In June, ITS published its files from the German Displaced Persons  in June. This makes it possible to search online for nearly one million names of Displaced Persons (DP) registered and surveyed in DP camps within the framework of the Care and Maintenance Program.

The DPs filled out questionnaires as a way the International Refugee Organization (IRO) could find out whether it could help these persons and if so how. The personal stories of the DP persons are delineated in the questionnaires and provide better insight as their lives.

Staatsarchiv Hamburg

On September 9  The IAJGS Records Access Alert first reported on the unconscionable destruction of over one million death records by the Staatsarchiv Hamburg. At the time there were few European news articles about this travesty. Since then there have been more news articles and several blog posts by other genealogical writers. 

As reported previously in the IAJGS Records Access Alert, IAJGS took this egregious act very seriously and wrote to various Hamburg government officials. IAJGS received a response from Dr. Carsten Brosda, Free and Hanseatic City of Hamburg Minister of Culture and Media.  In the letter he acknowledges that the State Archives reviewed their actions and concluded their decision to appraise the series was "flawed". "Both the Ministry for Culture and Media and the State Archives are in discussions with historians and researchers on the matter. To ensure that documents used by researchers are not subsequently weeded, the State Archives have already developed proposals for a workflow which would subject future appraisal decisions to multiple checks before weeding was approved.

Dr. Brosda also informed IAJGS that the crimes committed during the Nazi period are a major work of the Hamburg Archives and that next year the archive material from the Jewish communities of Hamburg pre-1945 are going to be digitized in cooperation with the Israel State Archives so that researchers will in the future be able to access the materials online from anywhere in the world. Archival materials and documents on the Nazi crimes of violence and injustice have already been digitized with Yad Vashem and the U.S. Holocaust Memorial Museum.  He also mentioned that documents including registers of birth, deaths and marriages and emigration records have been  digitized, indexed and made available online with cooperation from Ancestry.

Finally, Dr. Brosda stated that the Ministry for Culture and Media and the Hamburg Staatsarchiv plan to work more closely with historical research on the use of and access to archive material to ensure that all interests are taken into account.

Apologies to all looking for Friday Fossicking last week.. thanks to an extended power outage caused by an incredible wind storm, I was unable to read, compile or post, so this week's issue is a combination of what I had started and what I have found this week. Plenty to keep you busy for awhile.

Thankfully, we are safe and the house undamaged by the massive tree branch that knocked out our power lines...though it did fall far too close to our front door. We were very grateful to the Energex crew, who made it safe and cut up the debris dragging it to the side, giving us a clear exit.

The  Bibliothèque Historique des Postes et des Télécommunications (BHPT), (Historical Library of Posts and Telecommunications), a remote and obscure library recently reopened. For those researching people who lived in France in the 20th century this is the only repository open to the public containing nearly all the French telephone directories ever published, including those in France's territories and overseas departments.  They may be viewed on microfilm. To see the website and what is available online go to: http://www.bhpt.org/ and under Découvertes (discoveries) then click on Ouvrages numérisés (digitized works). 

The BHPT also includes the history of the postal service. This includes maps, showing waterways and roads used for transporting the mail as well as where your ancestors may have traveled. Before railways, the mail was done by land routes—same for your ancestors going to a port to emigrate, or otherwise travel.  Postal network maps are online and may be viewed at:

For the first time in 100 years the Archives de Montréal has moved its records from the vaults from the basement of city hall in Old Montreal, Hôtel de Ville. The move is for three years, expecting to return to the original site in 2022. The move is precipitated by renovations in city hall. More than 11,000 boxes of archival records have been moved, a total of 15,000 will eventually be relocated. Additionally, 11,000 registers will be relocated. The new location is:

5800 rue Saint-Denis
Montreal, Quebec 
H2S 3L5 
(Rosemont Subway)

Researchers can access the archives by appointment. Email: consultation_archives@ville.montreal.qc.ca

The second phase of the move will take place on January 28.

Digital rights are becoming more of an issue and in today's world we need to take heed of what we might need to do to permit our family or executor of estate access to our digital assets—photographs, documents etc.

Apple has a strict data protection policy which includes non-disclosure of other people's data stored on someone's account, including the deceased's without a court order. A widowed Canadian woman wanted her husband's password and Apple refused saying they would need a court order. The widow did not have access to her husband's Apple ID. A person's Apple ID is tied to their payment information and other sensitive data, Apple has instituted strong safeguards. The daughter wanted to download a card game from her late father's Apple computer to her mother's IPad. The family reached out to the Canadian Broadcasting System's consumer help line, Go Public, who went to apple, and then Apple apologized for the "misunderstanding" and the widow was given access. Apple did not say if they would change their policy going forth. In another case, Matter of Estate Swezey, an executor of the decedent's estate petitioned to turnover photographs stored in the decedent's ITunes or ICloud account by Apple Inc. Apple informed the executor that a court order would be required. The executor was the decedent's spouse and he was left all personal property and the residuary estate. The deceased took the majority of family photos and stored them on his Apple account—he used his iPhone for the photographs. While the will did not specify digital assets, the court found that in today's world digital assets in cyberspace are to be included. This was a New York State case, and the New York Legislature enacted EPTL Article 13-A (https://codes.findlaw.com/ny/estates-powers-and-trusts-law/ept-sect-13-a-3-2.html) ) applying traditional laws to this type of property, thereby giving fiduciaries the right to gain access, manage and delete digital assts. Apple was required to disclose the photographs stored in the deceased's Apple account.

Apple CEO Tm Cook has not been shy about his thoughts regarding consumer online privacy. He has suggested a data broker clearinghouse. He advocates for greater oversight regarding handling of consumer data. He said, "In 2019, it's time to stand up for the right to privacy — yours, mine, all of ours." His essay published in Time Magazine, he charges Google and Facebook as companies that amass "huge user profiles" data breaches and the vanishing ability to control our own digital lives."
He called on Congress to pass comprehensive federal privacy legislation. Cook believes there four principles:
1. Right to have personal information minimized. strip identifying information from customer data or avoid collecting it
2.The right to knowledge- knowing what data is being collected and why.
3. The right to access. Companies should make it easy for you to access, correct and delete your personal data.
4. Right to data security, without which trust is impossible.
